Man released after cops failed to follow arrest procedure

The Criminal Court has ordered the release of a man who was arrested by police officers in plain clothing.

The man was arrested on suspicion of using and selling drugs. The court ordered his release as he was arrested in contravention of Section 40 of the Criminal Procedure Act.

The clause referred in the court’s order states that an individual can only be arrested with permission from an officer with ranks above sub-inspector, and that an arrest can only be made while the officer is in full police uniform.
