MDP urges action against top court’s bench over judge’s removal

Some Judges of SC with Attorney General

Main opposition Maldivian Democratic Party (MDP) has filed a case at the Judicial Service Commission (JSC) against the Supreme Court and Chief Judge over removing a judge from her position.

Judge Mariyam Waheed was removed from her position by an order of the Supreme Court after her verdict on a case ordering the government to sign an agreement related to the operations of Vaavu atoll Bodu Mohora island.

However, the order was not signed off by any judges of the Supreme Court Bench.

MDP urged JSC to take action against Chief Judge Abdulla Saeed and the four judges of the Supreme Court Bench, declaring that they acted against the Constitution. Noting that a judge cannot take action against another, MDP call on JSC to take responsibility as the issue falls under their liability.

Furthermore, the letter addressed by MDP to JSC’s Vice President Mohamed Faisal noted that the Supreme Court’s action is an offence under the Penal Code as well.

The opposition party had earlier condemned Judge Mariyam Waheed’s removal and proclaimed that it was a “warning” to all other judges as well.
